Be interesting to see how Ashcroft deals with a very fundamentalist religious argument.

Amish couple who refused photographs in immigration proceedings sues government

A Canadian Amish man who has been living in the U-S is accusing U-S officials of violating his religious rights.

The man's immigration application was rejected when he wouldn't be photographed. And, after a January visit to Canada he was also denied re-entry to the U-S because he didn't have a photo I-D. The man was allowed back into the United States this week for an immigration proceeding later this month.

The man -- who hasn't been named -- is a member of the Old Order Amish, and follows a strict interpretation of the Bible's ban on graven images.

The man and his wife -- an American -- want a judge to throw out federal rules requiring photographs to be submitted with a residency petition. According to the lawsuit, similar requests for religious exemptions have been accepted in the past.
