In WA state, you have a right of appeal from a Decision of the Department to a Board where you are given a hearing to contest the determination of the Department. Common law rules of evidence apply. If the decision is adverse, you can appeal to Superior and get a jury trial on the evidence presented at the Board. I have tried many workers comp jury trials and hundreds of hearings before the Board.
