I would suggest that regulation is a better approach.

The problem with regulation is who has access to the political process to form the regulations. For some time, perhaps three, certainly two decades, corporate America has had far more access than worker America. Both the writing of regulations, their passage through congressional bodies, and their implementation by successive administrations has favored corporate rights over worker rights. I don't think this is arguable for the Rep administrations; I gather it can be argued one way or the other for the Dem administrations.

And without a union political presence, even as weak as it currently is, that uneven access only grows worse.
