The GOP doesn't mind frivolous lawsuits, so long as they're the ones starting them. What the rightwing is really trying to do with tort reform is protect polluters, HMO's, gun companies and other big corporate interests who fill their campaign coffers.

There does have to be more common sense reform with medical malpractice, and the insurance business in general often abuses their position (and insurers are big Bush contributors, as are lawyers).

Lawyers are only half the problem. And remember, many lawsuits are not frivolous at all. Many are righteous. Citizens need to retain their rights to sue for meritorious reasons and the big corporations always have the upperhand in the lawsuit world. The rightwing is therefore wrong to vilify "trial lawyers". This is a people vs. big companies issue. The people need good lawyers and the right to due process, including large damage awards, if merited. Sometimes of course it all goes way too far.
