The lack of cross-licensing could easily be explained by the fact that GMST does not use any of TiVo's IP but TiVo does indeed use GMST IP, and therefore they needed to license. Which probably explains the situation.

This leaves open the question then, if the DISH suit is successful, the suit will affect any traditional PVR type product, whether or not GMST provided the middleware for the technology. A cross-license would have prevented this result.
