Let's see if I understand your logic. Woman is in surgery room about to give birth. I come along and stab her in the stomach killing the fetus just before it stuck its nose out of the womb. With your reasoning I shouldn't be charged with murder. Had I waited 10 more seconds and stabbed the baby after it came out then I would be charged. Right?

This reminds me of an incident at a nearby hospital a few years ago. A man felt chest pains and rushed to the hospital. He collapsed just inches outside the doors of the emergency. The nurses and doctors refused to attend to the sick man. The hospital policy is that hospital staff can only treat patients in the hospital. The protocol to follow was to call for an ambulance to have him dragged into the hospital, at which point they could administer treatment.

The ambulance got there late. The man died inches away from the emergency, right before the eyes of doctors and nurses who could easily have saved his life.

The point being that logical rules enforced by illogical people aren't always logical.
