Diomed Initiates Patent Infringement Litigation Against Total Vein Solutions, LLC.

ANDOVER, Mass.--(BUSINESS WIRE)--April 5, 2004--Diomed, Inc., a subsidiary of Diomed Holdings, Inc. (AMEX: DIO - News), today announced that it has commenced legal action in the United States Federal District Court for the District of Massachusetts against Total Vein Solutions, LLC., of Houston, Texas, seeking injunctive relief and damages for infringement of Diomed's United States Patent Number 6,398,777 covering the endovascular laser treatment of varicose veins. Earlier this year, Diomed filed patent infringement actions against AngioDynamics, Inc., a subsidiary of E-Z-EM, Inc., and Vascular Solutions, Inc.
Diomed is a leading developer and marketer of minimally invasive medical technologies, including EVLT® for the laser treatment of varicose veins, and acquired exclusive rights to the patent from the five inventors of the procedure in September 2003.

"Total Vein Solutions has ignored Diomed's patent rights in the field of endovenous laser treatment of venous incompetence and is openly promoting and marketing laser fibers and associated procedure kit components without a license from us", stated James Wylie, President and Chief Executive Officer of Diomed Holdings, Inc.
