The tax treatment of options has apparently had some fuzzy areas for many years. I don't think your situation is one of them. I have relied on a guide available from the Options Industry Council authored by Ernst and Young. You can download a PDF version from the following link. The download link is at the bottom of the page. Several other resources are available also.
