The example you quoted was a prosecution of discrimination against homosexuals by the Saskatchewan Human Rights Commission. Free speech is an important right, but not an absolute right or the only right. It is curtailed, even in the U.S., when it is the only way to prevent harm or the abridgment of other rights. That is why a prohibition on the promotion of genocide is reasonable.
