Does anybody think Microsoft might be settling its lawsuits in part so it can show a gain as a result of decreasing the reserves it has set aside for them? I.e. if they settle for less than the amount reserved, isn't that a gain? Similar considerations could also affect how they structure the settlements -- e.g. there might be some accounting or tax benefits in considering part of the settlements as IP licensing fees rather than damages. The dollar amounts involved are big enough that the settlements might obfuscate results from operations.

I also wonder how much of the settlements, if any, has been paid by insurance.
