No more so than in the civilian world.

An Article 31 investigation is the equivalent of a Grand Jury proceeding. Grand Jury testimony is always behind closed doors.

The Army has far more to lose than to gain here. Everything must be done properly including protecting the rights of the accused. Senior level commanders will want to prove that the Army can appropriately and fairly deal with this and they will. Those perpetrators found guilty face severe punishment. Those commanders who were in the direct chain-of-command face career terminating action. It is not out of the question imo that some of them may face court-martial as well.

Yesterday, a three-star general was quoted as suggesting non-judicial punishment (Article 32) for some. I promise you that comment ended his career. There are going to be lengthy jail sentences at hard labor and dishonorable discharges for these folks.

No amount of training or lack thereof has anything to do with this. The defense lawyers will try to influence thinking otherwise, but the men and women serving honorably will comprise the Court-Martial Boards. They know what the training is that every soldier receives in basic and in mission pre-deployment training.

During a Court-Martial, lack of training will not be an acceptable excuse for rape, sodomy, or assault and battery...period.
