Fair enough... but it seems that when he was submitted for decoration, the military would have reviewed the evidence.

If courts marshall was warrented, someone would have to have brought charges, based upon the same set of events.

The military made it's decision --- are you trying to second-guess them at this late date?

(PS - courts marshalling people for killing the enemy while in firefights would hardly have been a morale booster... is that what you are suggesting now? How many other medals winners do you want to re-open investigations on?)
