RusAl Suit Thrown Out

MOSCOW --Oleg Deripaska's RusAl, which makes one-eighth of the world's aluminum, said a U.S. appeals court rejected a rival's bid to proceed with a lawsuit accusing the company of illegally acquiring Russia's fifth-largest smelter.

Mikhail Zhivilo, former majority owner of the Novokuznetsk smelter, alleged in 2000 that RusAl used bankruptcy proceedings to gain control of the Siberian plant. A U.S. court in March 2003 refused to hear the case and Zhivilo appealed.

"This action has little or no connection to the United States, and thus little or no claim to the time and attention of an American jury or court," the U.S. Court of Appeals for the Second Circuit in New York said, according to a statement by RusAl.
