No, I actually assume it is not justifiable. I do not rule out that there may be mitigating factors that would affect the severity of punishment of the responsible parties.

In the hypothetical, you fail the ethical test, and make yourself, in effect, responsible for the murder of innocents because you would not lower yourself.
