I'm not so sure that it was.

There's a very good chance that these soldiers will be able to make a credible plea that they cannot obtain a fair trial and that they're being made scapegoats by their commanders and politicians.

Which means there's a very good chance that they might never be convicted..

There were procedures that could have been followed, such as making the report and photos directly available to the Senate and House Intelligence and Armed Services committees.
