Travelers v. Martin, 28 S.W.3d 42 (Tex.App., Texarkana, 2000) Illustrates how important the standard of medical necessity is.

In this Texas case, the appellate court held that 1. under Texas workers' compensation laws, care which relieves pain( or other effects naturally resulting from injury is compensable even though the condition may not be curable or the care in question is not actually curing the condition, and 2 the trial court did not abuse its discretion when it refused to allow an orthopaedic surgeon to testify as an expert regarding the need for chiropractic care when no evidence was provided that the surgeon had training or expertise in the field of chiropractic.

The court upheld 10 years of treatment.
