The Canada Border Services Agency imposes provisional duty on frozen self-rising pizza
OTTAWA, May 17 - The Canada Border Services Agency (CBSA) announced today that it will assess provisional duty on imports of frozen self-rising pizza originating in or exported from the United States of America.
This decision follows an investigation that the CBSA initiated on January 2, 2004, after receipt of a properly documented complaint filed by McCain Foods Limited of Florenceville, New Brunswick. The company alleges that the dumping of the goods in question is harming Canadian production by causing price erosion, price suppression and lost sales.
The preliminary results of the investigation show that imports from the United States of America were dumped into Canada by an estimated margin of dumping of 39.4%, expressed as a percentage of export price. A provisional duty will be imposed on imports of frozen self-rising pizza originating in or exported from the United States of America to prevent injury to Canadian production.
Dumping occurs when goods are sold to importers in Canada at prices that are less than the selling prices in the exporter's domestic market or at unprofitable prices. The Special Import Measures Act protects Canadian producers from the damaging effects of such unfair trade.
On March 2, 2004, the Canadian International Trade Tribunal (Tribunal) made a preliminary determination that the evidence disclosed a reasonable indication that the dumping of frozen self-rising pizza has caused injury to the domestic industry. The Tribunal will now begin its inquiry into the question of injury to the Canadian industry. At the same time, the CBSA will continue its investigation regarding dumping and will issue a final decision by August 16, 2004.
