Thanks for the feedback. Doctrine of equivalents will not become a hot issue for this case until after the Judge decides what the claims mean. If its necessary then I can go through it again. Freeney's testimony will be more important in front of the jury. What Freeney says he meant when he filed the patent isn't important to the judge. What she has to decide is what would someone else who read the patent have thought he meant. (His intent is not relevant) Although his testimony now should help explain the Canadian application (hopefully as I explained it). Does anyone live close to White Plains NY. That is where the briefs I want to copy are located. I'll pay for photcopying if someone else does the leg work. GRC
