Why is the worlds largest NIMH battery manufacture (Sanyo) selling cylindrical D cells for hybrid autos instead of superior prismatics? Because that is what is meant by "limited rights in north america". Why is Ford using D cells in there Escape? Because right now they are cheaper and their supplier is not in a lawsuit. Cobasys may be the only one who will be able to sell larger batteries in the US. Matsushita is selling prismatics but that is one of the reasons for the lawsuit. If ECD allows Matsushita to sell the larger batteries in the US, then they will want a lot more. IMO
