British Columbia wins a round in fight with tobacco companies

VANCOUVER (CP) - The B.C. government has won the latest round in its six-year fight to force big tobacco companies to pay for health-care spending related to smoking.

The B.C. Court of Appeal ruled Thursday that the Tobacco Damages and Health Care Costs Recovery Act is constitutionally valid. The B.C. Supreme Court had struck down the act, saying the province was trying to exceed its constitutional reach outside the province to redress tobacco-related wrongs.

The B.C. government appealed the decision and the Appeal Court heard the case last November.

The legislation was first passed in July 1998 and the first lawsuit was filed in November 1998. The law was ruled unconstitutional Feb. 21, 2000.

New legislation was passed in July 2000 and a second lawsuit was filed against the tobacco companies in January 2001.

The B.C. Supreme Court ruled in June 2003 that the legislation was unconstitutional. The government filed an appeal in July 2003.
