Where's the line to cross? Who defines under what circumstances

The historical tradition is that the winners of a war are off the hook and the losers are tried for war crimes. That's how the civilized world handles it.

There may be some general questions about what happened post WWII.

See: The statistical data of the old German empire, 1880. Page 3, left column, approximately half way down the page. [3 meg PDF file] library.wisc.edu

You'll find some summary data on the population. Posen and Pommern were provinces of the old German empire that are now contained in Poland. Generally speaking, if you were Protestant, you were ethnically German, if you were Catholic, you were ethnically Polish. Today, Poland is 95%+ Catholic. One can ask what happened to all the ethnic Germans post WWII?
