And that begs the question as to under what authority and jurisdiction the Allies had the right to try, convict, and execute sentence on former Nazi and Japanese leaders..

The answer is none (or at best ambiguous).. They, as victors, gave themselves the right to punish the defeated for starting the aggression...

And I think that's pretty much the basis the US is taking with regard to waging war on international terrorism, such as Al-Qaeda.

Just as new precedent was set for conducting the military tribunal at Nuremberg, the same will likely be the case for Islamic militants acting outside of the authority of any state.
