As I mentioned in an earlier post, (#373) there have been some developments in the dispute. My guess would be that the earlier decision overturning the Perseptive patents will now be reversed in the light of a new appeals court decision in an unrelated case.

Such a decision would mean that the suit against Biosepra/Sepracor would proceed to the litigation of whether the Perseptive patents were in fact infringed.

I don't think the suit is particularly relevant to SEPR's long term future, and I wish they would settle it. As I mentioned before, I bought some Perseptive calls by way of some insurance - the suit has a much bigger impact on Perseptive than it does on Sepracor.

(Caveat: Although I am a (non-practicing) attorney, my patent law expertise is minimal. Unfortunately, while Harvard Law School offered umpteen courses on 18th century Chinese law and the like, they never saw fit to offer a course in patent law when I was there).
