The truth is, Davis declared a State of Emergency and VOIDED the law that dictated California wholesale power deregulation. He then entered into long term supply contracts with producers, an act that was illegal (according to the deregulation bill). This means that he was not powerless. Why didn't Governor Davis declare a state of emergency sooner? I don't know, maybe as a personal favor to President Clinton.

It is blatantly false to say that the Bush Administration, had stacked 3 out of 5 votes against Davis. It is a FACT, that between January 2001 to May 2001, there were three members on the FERC, and ALL THREE WERE CLINTON APPOINTEES - and 2 VACANCIES. It is a fact that the two vacancies were not approved by the Senate till mid to late May 2001. Furthermore, if all else fails, there is an organization called the California PUC, they had the power to raise the price of electricity to end users (to lessen demand). And as all the members of the CPUC were probably Davis Appointees, he could have leaned pretty hard on them.
