Facts: Enemy combatants were captured on the battlefield. They are not charged with a crime at this point nor is it necessary to charge an enemy combatant with a crime, since the designation of ‘enemy combatant’ is sufficient enough in itself to restrain and detain the combatant person. It is also preferable in our society to simply eliminating them on the battle field when possible. The combatants are members of the Al-Quaida force that has announced the goal of killing 4 million Americans as a prerequisite to a broader campaign. This position of the Al-Quaida enemy is active and unresolved.

The enemy was captured in battle in a foreign country and is being held outside of the US. It is not a civil matter but a military matter.
