Profits to Charity? That's crazy talk!

They also reached a settlement so that Disney does not benefit from the movie it turned its back on. Any profits from the film’s distribution that go to Miramax or Disney will be donated to charity, the statement said.

The Weinsteins have paid Disney the six mill US which the film costs and agreed to put the profits into a charity. Gee, isn't that good of them?

Sadly, the profits are not profits as we would define the word. Instead, it refers to any monetary gain which came from a sales increase caused by the controversy.

"Disney did not want the Weinsteins to benefit financially from controversy that arose over the film, according to executives close to the deal. They calculated a sum that the film might have garnered from distributors before questions arose about the film's distribution, and agreed that the differential would go to charity, the executives said. The charity was not disclosed."

In other words, they worked out the massive amount of money Disney expected to make, allowed Weinstein to grab this much, and then agreed that any further excess would be forgone. And of course their costs are taken out first.

If it does turn out the Weinsteins will lose because of a restricted access to cinemas (which I reckon is the real problem) then the charity gets nothing at all.
