Still, Scalia should have recused. How would you like it if you were being sued, and found out the guy that was suing you was out hunting with your judge the week before?

And it's not over, it was just a point of law. Only two wrote that the case should be dismissed entirely; that's "7-2" that it shouldn't be dismissed, not close as you say. Stay tuned.
