You're not talking about what "is", you're talking about what "should be," In your opinion.
Marriage as it is constituted today is what "is." Marriage as it is constituted today is the status quo.
People get married for all kinds of reasons. Far beyond the scope of this thread, even just studying the law of marriage takes an entire semester and could easily take more. Throw in anthropology, economics, sociology, psychology, history, and I've got enough material that all by myself I could probably lecture an hour three days a week for several years without repeating myself.
The institution means radically different things to different people in the same society, and far more radically different things over time and space. Throwing it out is out of the question.
If it doesn't suit you, personally, you can adapt it to fit you and your parter however you decide, using contracts, wills, powers of attorney, and so forth.
If you want to reinvent the wheel to suit yourself, have at it. You won't be the first, nor the last. |
