The Constitution provides for the keeping and carrying of commonly used military small arms like it or not. The word sport or sporting purpose is not to be found anywhere in the Constitution or in Case Law, legislative history or in the Federalist Papers. The sporting purpose test comes from the Nazis in 1938 in their unique firearms legislation that not only banned assault weapons but also disarmed the Jews in preparation for the Holocaust.
