Because, as in this case, barring a legal requirement, it is the physicians word against a third parties word. In other cases it could be the physician's word against the patient's word. Are you claiming that the patient's always remember what they were told and what they weren't. ... I told you such and such... I don't remember that... you must have forgotten or not been listening, understandable since you were sick or traumatized during your visit. Where is the legal case? It is there if sign off is legally required, and does not happen. It is not there if no sign off is required.

The third party in this case has no first hand information and the physician does. Who's word will stand up in court? The word of the physician and the corroborating pharmacist who have proven standards of practice that back them up, against a third party who does not have information and was not entitled to receive any.

I propose a standard of informed consent. This implies that the consent is based on an understanding of the information. If a physician gets her retarded patient to sigh off on some experimental treatment, we would have a case unless the physician could prove that the information was understood. Gaurdians are not always involved so in some cases getting informed consent might involve some educational approaches as well.

So another reason for sign off. The physician not only has to provide documentation on why treatment wasn't provided but also as to the referral.
