When did this happen? I don't remember it. The last war I remember Congress declaring was against poverty. I don't think we are winning that one either.

More seriously though, I think James Madison and crew envisioned not giving too much power to the Presidency. They stipulated that only Congress had the power to declare war. They didn't want to make it too easy for us to get into war.

You can't blame Presidents for wanting the ability to go to war whenever they feel like we should go to war. This is not only a Bush problem, it is a problem with all Presidents. The people who designed the Constitution recognized the problem - Presidents have been able to get around the Constitution.

The problem has been that Congress has not been doing it's job. They have not had the courage to fulfill their responsibilities. They will vote what is popular at the moment. They will assist Presidents to get around the Constitution so that they do not risk not getting re-elected.

It's not easy to design a Constitution that is 100% fool proof.
