The whole issue at hand is that it isn't being allowed to be left to the states. It is being decided by the courts, in spite of the legislatures. What happens when a gay couple married in Mass. goes back to Wyoming (for example) and sues for recognition of the license? It is not guaranteed that the court would rule on the side of the will of the people of the state of Wyoming, via the legislature. If that were not the concern, a Constitutional Amendment would be moot.
