My argument is, we'd better provide those on the front lines of our security a bit more flexibility then "look at more than two people and we'll fine you for racist behavior."

I'm not going to argue that that policy isn't weird. But OTOH, no one is keeping the airlines from scrutinizing more than two. They can do it. They just risk a fine. Let's say that some attentive gate attendant or security officer was suspicious, searched five rather than two, and found something. Do you really think the airline would be fined? Probably get a medal. I don't know what instructions those officials doing the screening get. Maybe their instructions are to ignore the regulation if circumstances warrant. In that case you have a regulation that discourages wanton profiling but still allows for appropriate security. I don't know that we know enough to make such a definitive judgment on this.
