The Illogic of ILSA

The Iran-Libya Sanctions Act (ILSA) of 1996, sponsored by former Senator Alfonse D'Amato (R-NY), allows the President to sanction foreign companies that invest over $20 million in the energy sectors of Iran or Libya. ILSA expires August 5 but was renewed by Congress for a second five-year term on July 26. Unlike the multilateral sanctions on Iraq, which directly sanction Baghdad by prohibiting the flow of certain goods into that country, ISLA places unilateral sanctions on foreign companies that seek to invest in Iran.

The logic of the bill is that blocking investment in the Iranian energy sector will reduce the amount of money that Iran might otherwise invest in rejectionist groups such as Hizballah and Hamas. This is the primary concern of AIPAC (American-Israel Public Affairs Committee), which lobbied hard for the five-year extension. The bill also is directed at limiting the resources available to Iran to obtain nuclear, chemical, and biological weapons.

ILSA passed the Senate on July 25 by a vote of 96-2, and the House on July 26 by a 409-6 margin. The only debate was over whether to extend sanctions for the regular five years or two-years — as proposed by Secretary of State Colin Powell.
