There is another insidious undercurrent at work here, that of
intimidation by implied litigation. In the 22 August version of "The
Daily Interpreter" at Westergaard Online, there is the following:

"This service one arm of WIBN which has been designed to
continually sweep the Internet to identify parties such as "Steve
Pluvia" engaged in circulating rumors, fraudulent or intentionally
misleading information or analysis for financial gain, competitive
advantage or other purposes."

In my opinion, that passage contains the implicit threat of legal
intervention. Otherwise why continually sweep the Internet in
search of miscreants? To engage them in creative debate? I don't
think so.

How many of us could afford to pay for a landmark legal battle over
freedom of speech on the Internet against a deep-pockets
adversary? For the few who could afford it, how many would see
it as worth the trouble?

In my view, many borderline lurkers already have decided never
never to post a dissenting opinion on a public forum. Westergaard
has already won his cowardly skirmish in my judgement.
