The Company Act may not apply to holding client assets. Speaking of litigation, I note that SanDisk has appointed the former counsel at Texas Instruments to a newly created position dealing with intellectual property rights. This worries me somewhat:

Texas Instruments has been sued by QUALCOMM for a breach of contract in a licensing agreement between TI and QCOM. The guy just appointed by SNDK may have had some involvement in this issue, which ultimately could be a major problem for TI. The crux of the problem is that the licensing agreement forbids any public mention of its terms. TI appears to have discussed the terms in public, leading to the lawsuit. I don't know if the new SNDK officer was involved, but if he was, he should have given TI a stern warning. On the other hand, maybe he did, and his warning was ignorned, so he decided to leave. Who knows?
