They were being held with an undetermined status until recently. Since I have no idea what went into the determination to treat them as protected non- combattents, but it is clearly an unusual situation, and not what is ordinarily meant by "harboring terrorists". For one thing, they are disarmed, and military action is interdicted. If we were "harboring" them, we would be abetting their activities.
