This is not true. You cannot be sued for expressing your opinions. But if you falsify information and present it as fact, then you can very well be sued.

For example, Moore says that after Bush was told the country is under attack, he sat there in the classroom and read my pet goat for 7 minutes. If this was a lie, then Moore could very well be sued for it. Now the part that he cannot be sued for is Moore's opinions as to what may have been going on inside Bush's head.

So in the end, you may disagree with Moore's opinions and analysis, but you cannot disagree with his facts.
