We've released some of our detainees. And if we can be sure they have achieved permanent non-combatant status, assuming we don't have some kind of individual criminal charge on them, I believe we'd release our own detainees.

Now in reality, it's probably going to be a very long time before we can consider that non-combatant status achieved for most.

Why not hand them over to Iran? If Iran has al Qaida who we know attacked us, would we not want Iran to hand them over? If Iran was handing over AQ to us and we were assured Iran would not simply summarily execute people we turned over to them, that would be all right.
