I have to believe that, as a commissioned officer, he'd have been subject to possible disciplinary action and court martial for his conduct.

I think we are being a little hard on Kerry for his actions after he went off active duty. He was basically "out," unless recalled. He had no duty to perform. He was free to live his life as he please.
