Mel,

The original LEXIS was a subsciption service. However, to avoid being anticipating prior art you must find a claim limitation that was not provided by LEXIS. Thus, just because Lexis was a subsription service does not mean it can't be anticipating prior art. You have to find something in the claims that isn't in LEXIS. That is why I looked at the austhorization code. LEXIS didn't have an authorization code for each document (there was a sign on ID & password but that originated with the local computer). Once signed on, you had access to everything.

If you or anyone else can point out other differences I would appreciate it. By differences I mean something in the claims that wasn't in LEXIS.
