It would be difficult because all of the case law to date has supported that right. AFAIK, there has been no successful challenge of the states rights in this area. And it has been tried many times with respect to polygamy, mixed marriages, under-aged marriages and first cousin marriages. Now admittedly, in the latter two cases the states often decide not to push the issue, but every time they did, they won.

I don't see the point of amending the Constitution or attempting to over-ride states rights on the off-chance that something might be a problem. Nor do I think that it should be done because allowing it might make peoples lives complicated...
