I don't know about Washington State but in VA the lawyers fee comes out of the Worker's Comp award. Lawyers only get involved if there is a difficult case or if it's big enough that lots of evidence is needed.

Ordinary people don't know how to put together cases. Worker's comp rules here are pretty relaxed, they don't usually require sworn testimony, will rely on medical records but the doctors don't always write things out right. Also ordinary people don't know how to meet deadlines, and if you don't meet deadlines the case is gone.

Very few lawyers around here do Worker's Comp. I won't take them, refer them out to specialists. Too paperwork intensive, low awards - 20% is standard - you need a staff of paralegals to generate enough cash flow to make it worthwhile.

Lots of legal work is like that, asbestosis, class actions, nobody's claim is worth much so some specialists make it on volume and the rare big case.

People scream because they didn't get much, well, tough, the case wasn't worth much. Some smart lawyer figured out how to handle several thousand small cases and make everybody a little bit and himself a lot.

If you're really injured don't bother with a class action.
