As a non-holder, I didn't really want to give advice to shareholders but if you accept my premise, I still think current shareholders should sell rather than waiting for the MMC to save them. If you still believe in Pennsaid, you can very likely buy back much cheaper after the financing regardless of who is running the company.

Perhaps I'm wrong. Kuhne is the big unknown. To pay off just his October 2004 portion would require the issuance of about 27 million shares. The company can't issue those shares without shareholder approval. I don't believe shareholders will give that approval so the deal has to be changed or the company needs to go into bankruptcy reorganization.
