I better give my standard disclaimer. I am simply stating the law as I understand it. Anyone who wants a true legal opinion had best hire an independent lawyer. I am really acting as an investor in GIFT, not anyone's lawyer. Most of the legal points I state are easily doublechecked. All of the facts are easily checked as well. The combining of them can be done by anyone, and should be done by everyone.

I strongly suggest that each person read all of the briefs, then make your own judgement. Assume a party is correct on an either the law or the facts, unless the other side contradicts. Then ask yourself which side is right.

There are two issues here. First is concern it will cause the judge to rule in defendants favor on claim interpretation. I give that a 3+ right now but I haven't seen GIFT's brief. It could get better or worse. Second is concern that if the judge interprets the claims in favor of GIFT, the jury goes against GIFT. I'd give that a 3-.

I value GIFT by multiplying the price I'd expext if GIFT wins, by the likelihood of winning. The current GIFT price is less than that result, so I am buying GIFT. Of course risk tolerance plays a big factor. There is a possibility (in my mind) that GIFT could lose, and would then be worth close to nothing. Thus, I am willing to risk losing my entire investment in GIFT.
