The "preponderance of evidence" language indicates this crazy CBS announcement was written by lawyers. No one but no one is thinking about the criminal law issues inherent in a violation of 18 USC 494, the statute that establishes criminal liability for knowingly using forged federal documents. If Rather is responsible, which I sincerely doubt, he'd better lawyer up. Shoot, he'd better lawyer up anyway since he might face a conspiracy or aiding and abetting charge.
