I don't think the fact that neither were sworn under oath would matter, at least not where I practice law.

We don't know that it was an intentional lie. We don't know that Rather made that call and not one of his staff.

It's a long way from what we know to make a case for disbarment. Admonishment, reprimand, maybe. But not disbarment. At least not where I practice.
