I was being somewhat facetious.

I imagine there are any number of people
who could ultimately have a right of action
against Rather/CBS over this debacle, but
would probably file their own suits.

News organizations could sue to get access
to discovery generated in such a suit, but
would not do so in the status of parties and
therefore could not initiate discovery of their own.
