Look, there is the rule of law, which the US is trying to promote around the world. Part of the rule of law in the US includes the death penalty. If a person in custody - terrorist, serial killer, spy or whatever - is convicted of a crime that the jury/judge decides merits the death penalty, they will be killed. That's the US legal system.

John Fowler said he wants Al Qaeda jihadists killed. I just telling you it will not happen. With the burden of proof required to convict anyone in the US, a surrender and capture of Al Qaeda jihadist means sparing his life, because he is much safer in the US custody than anywhere else.

Because we can't convice OJ Simpson. Shoe bomber's life was spared by the US Justice system, and now he is happily suing over his jail conditions: cnn.com

I repeat, the US will not kill any Al Qaeda, they will be given another chance to kill more Americans (and non-Americans). We will not get serious about Al Qaeda until we face a doomsday (if then).
