Captured "insurgents" in Iraq today are not POWs, they are common criminals. Why do you supposed\ that is? Trying to compare Iraq with Japan makes no sense. Different time, different place. The distinction between "common criminals" and "soldiers" is not a significant point if they're shooting at you.
